Terms & Conditions

Welcome to Commuza. These Terms and Conditions ("Terms") govern your access to and use of the Commuza platform, including the website at commuza.ug, the web application at app.commuza.ug, and the Commuza mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Definitions

  • "Commuza" refers to Commuza Ltd, a company registered in Uganda.
  • "Community" refers to a gated estate, condominium, or residential development registered on the platform.
  • "User" refers to any individual who accesses or uses the Service, including community managers, board members, residents, and security staff.
  • "Subscription" refers to the paid plan selected by a Community to access premium features.

2. Account Registration

To use the Service, you must create an account using a valid Ugandan phone number (+256). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service to transmit harmful, threatening, abusive, or unlawful content.
  • Attempt to gain unauthorized access to other Users' accounts or Community data.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated tools to scrape, collect, or extract data from the Service.
  • Sublicense, resell, or redistribute the Service without prior written consent.

4. Multi-Tenancy & Data Isolation

Each Community's data is isolated within the platform. Community managers and board members may only access data belonging to Communities they are authorized members of. Cross-community data access is strictly prohibited and technically enforced.

5. Subscriptions & Payments

Communities may subscribe to paid plans to access premium features. All payments are processed in Uganda Shillings (UGX) through supported payment methods including MTN Mobile Money, Airtel Money, and bank transfers via our authorized payment processors.

  • Subscription fees are billed monthly or annually as selected.
  • Fees are non-refundable except as required by applicable law.
  • We reserve the right to modify pricing with 30 days' advance notice.
  • Failure to pay may result in suspension or termination of access to premium features.

6. Community Billing

The Service enables Communities to bill residents for levies, assessments, and other charges as determined by the Community's management board in accordance with Uganda's Condominium Property Act, 2001. Commuza acts solely as a technology platform and is not a party to financial obligations between Communities and their residents.

7. Intellectual Property

The Service, including all software, designs, logos, and content, is the property of Commuza Ltd and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Limitation of Liability

To the maximum extent permitted by law, Commuza shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service.

10. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data export options will be available for a period of 30 days following termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes shall be subject to the exclusive jurisdiction of the courts of Uganda.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
